Legislative Requirements
There are now several pieces of legislation that deal specifically with records management issues. The most significant of these are as follows:
- State Records Act, 1998 (NSW)
- Privacy & Personal Information Protection Act, 1998 (NSW)
- Health Records & Information Privacy Act, 2002 (NSW)
- Government Information (Public Access) Act, 2009 (NSW) [This replaced the FOI Act]
Many of the compliance requirements under the State Records Act and some other legislation have been built into the TRIM system. By placing documents into the correct files in TRIM you will be automatically complying with these requirements.
The UWS Records Management Policy also includes many of the compliance requirements. To understand your obligations you should read the policy (UWS Records Management Policy).
In addition there is other legislation whose main focus is not recordkeeping related but which includes some recordkeeping provisions. Business units need to be aware of such legislation that has specific requirements for their particular area. An example of such legislation is the Education Services for Overseas Students Act, 2000 (Commonwealth). This has requirements for the creation and retention of some student related records.
